Terms of Service

Welcome to WakieUp. These Terms of Service ("Terms") are a legal agreement between you and WakieUp ("WakieUp," "we," "us," or "our") that govern your use of the WakieUp mobile application and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use WakieUp.
1. 1. What WakieUp is
WakieUp lets you record short video or audio messages ("Wakies"), wrap them in an animated cover, and schedule them to unlock for someone you are connected with at a future moment in that person's local time — individually, or together with others as a Train. Until a Wakie unlocks, its sender and contents stay hidden from the recipient. The unlock time is enforced on our servers, not merely hidden in the app.
2. 2. Eligibility and your account
You must be at least 13 years old to use WakieUp. You are responsible for keeping your account credentials and device secure, for the accuracy of your account information, and for all activity that occurs under your account. One person per account; do not impersonate anyone or misrepresent who you are.
3. 3. Connections and consent
Wakies can only be exchanged between two people who have each accepted a connection with the other. You decide who can reach you, and you can remove or block a connection at any time. Because a Wakie's sender and content remain hidden until it unlocks, connect only with people you actually know and trust. We provide trust signals to help you decide, but the decision to connect is yours.
4. 4. Your content and the license you give us
You own the Wakies you create. You keep that ownership. To operate the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, encrypt, process, and deliver your content solely to the recipient you choose and solely for the purpose of providing the Service to you. We claim no other rights to your content, and we do not use it to train advertising profiles or sell it to anyone.
You are responsible for the content you send, and you represent that you have the right to send it. Once a recipient opens a Wakie, they may be able to save a copy; what someone you chose to message does with a saved copy is between you and them, so share thoughtfully.
5. 5. Acceptable use
You agree not to use WakieUp to send anything unlawful, threatening, harassing, hateful, or sexually explicit toward an unwilling or underage recipient, or that is otherwise abusive. You also agree not to attempt to defeat or circumvent the time lock, access content that is not yours, reverse engineer, probe, overload, or disrupt the Service, or use WakieUp to send spam. Recipients can report any Wakie. We review reports and may remove content and suspend or terminate accounts that violate these Terms.
Keeping Wakies special. Wakies are meant to be a treat, not a flood — so there's a limit to how many unopened Wakies you can have waiting for any one person, and how quickly you can send them. There's also a daily limit on the Wakies you send to yourself. These limits protect the people you send to, and they may change as we tune them. Using WakieUp to overwhelm, pressure, or harass someone is never okay and can lead to losing your account. If someone's Wakies ever make you uncomfortable, you can block or report them right from the app — even someone you're connected to.
6. 6. Privacy of your messages
Wakies are private between the sender and the recipient. We do not watch, preview, or analyze your Wakies for advertising. We access message content only when a recipient reports it, when we are required to for safety or by law, or when you ask us to in order to help with support. Our Privacy Policy explains this in full.
7. 7. Purchases, subscriptions, and gifts
WakieUp may offer optional paid features (such as a WakieUp+ subscription), billed through your app store under its terms. Except as required by law or expressly stated, fees are non-refundable.
You can also attach a gift to a Wakie. The gift is something you already own and provide yourself — a gift-card code, a prepaid card, a redemption link, a photo of a card, or simply a promise. WakieUp does not sell, issue, fund, or process gifts, and never takes payment for one. We hold what you give us in encrypted form, keep it hidden, and reveal it to your recipient at the time you chose.
Because we are not a party to your gift, we do not validate, guarantee, or arbitrate it. We cannot confirm that a code works, that a card holds a balance, or that a promise is kept — those are between you and your recipient, and any gift remains subject to the terms of whoever issued it. There is nothing for us to refund, because no purchase is made through WakieUp.
So that a gift is not stored indefinitely, we delete its contents 90 days after it is revealed, and also if it is never claimed long after its unlock date or is left unfinished. The gift's title and note are kept as a memory. Save anything you want to keep.
8. 8. Third-party services
The Service relies on third parties — including your app store and payment and gift-card providers — to deliver certain features. Your use of those features may also be subject to the third party's terms, and we are not responsible for third-party services we do not control.
9. 9. Termination
You can delete your account at any time from Settings. We may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk or legal exposure. Wakies you have already delivered remain with their recipients; your identity on those delivered Wakies is anonymized when your account is deleted.
10. 10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We work hard to deliver every Wakie at the right moment, but we do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any Wakie will be delivered without delay.
11. 11. Limitation of liability
To the maximum extent permitted by law, WakieUp and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, content, profits, or goodwill, arising out of or relating to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. 12. Indemnification
You agree to indemnify and hold WakieUp harmless from claims, damages, and costs (including reasonable legal fees) arising out of content you send or your misuse of the Service or violation of these Terms or the rights of others.
13. 13. Governing law
These Terms are governed by the laws of the United States and, where applicable, the state in which WakieUp operates, without regard to conflict-of-laws rules. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.
14. 14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will ask you to review and accept the new version before you continue using WakieUp. Your continued use after an update means you accept the updated Terms.
